Councillor disqualified - Fenside by-election to be held

Nominations can now be made for the vacant Boston Borough Council seat for Fenside ward.

A by-election is being held following the disqualification of Cllr Elliott Fountain who failed to attend any meetings over a six-month period.
Nomination forms can be obtained from the Returning Officer at Municipal Buildings, West Street, Boston, Lincolnshire, PE21 8QR, who will, at the request of any person, prepare a nomination paper for signature.
Nomination papers must be delivered to the Returning Officer no later than noon on Thursday, August 8, 2013.
If the seat is contested the poll will take place on Thursday, September 5, 2013.
Applications, amendments or cancellations of postal votes must reach the Electoral Registration Officer at Municipal Buildings, West Street, Boston, Lincolnshire, PE21 8QR, by 5 pm on Tuesday, August 20, 2013.
Applications to vote by proxy at this election must reach the Electoral Registration Officer by 5 pm on Tuesday, August 20, 2013.
Applications to vote by proxy at this election applied for on grounds of physical incapacity, where that physical incapacity occurred after 5 pm on Tuesday, August 20, 2013, must reach the Electoral Registration Officer by 5 pm on Thursday, September 5, 2013.
Chief Executive Richard Harbord said: "Under Section 85 of the Local Government Act 1972, it is expressly provided that where a member fails to attend at least one meeting in a period of six consecutive months he ceases to be a councillor, unless the failure was due to some reason approved by the Council prior to the expiry of that period.  Unfortunately, as Cllr Fountain failed to meet this requirement and made no request for his continued absence to be approved, there was no alternative but to declare his seat vacant."
