This is when the government, local council or utility company has the legal right to buy or take rights over your private property if it falls within a public or private construction project such as: - a housing development
- electricity pylons and cables
- flood defence works
- sewer, water or gas pipe schemes
- rail or road building projects
Different compulsary purchase or statutory powers exist to implement the above types of schemes. For example, water pipes are laid under the statutory rights under the water Industry act 1991 and a road by-pass will have its own compulsary purchase order through the Acquisition of Land Act 1981. In all cases, the owners and occupiers of the properties to be acquired or affected by the scheme will be served with notices. All the schemes provide compensation to owners and occupiers directly affected by the scheme. The process of Compulsory Purchase that the Borough Council would follow the following basic steps: - The Council authorises a Compulsory Purchase Order.
- The Order is made and submitted to the appropriate Secretary of State.
- Notification of the Order is served on all those with an interest in the land who have a right, together with anyone else, to object to the CPO within a statutory time period.
- If there are objections and these are not withdrawn a Public Local Inquiry is held.
- Following an Inquiry the Secretary of State will issue his decision on the CPO which will be to either confirm the Order, possibly with modification, or to not confirm the Order.
- If the Order is confirmed the Council will proceed to acquire the land. All those having an interest in the land will be compensated. The rules of compensation are complex but as a general principle no owner should be worse off as a result of the compulsory purchase.
